Freedom of Information Act (FOIA) Requests


The Michigan Freedom of Information Act (FOIA), Public Act No. 442 of 1976, establishes procedures to ensure that all persons, except those persons incarcerated in state or local correctional facilities, are entitled to review or receive copies of documents possessed by government entities.  The law requires that a request for documents be submitted in writing.  Please be aware that there are certain items that are exempt from disclosure.  Section 15.243 of the act provides a list of exemptions.

Beginning July 1, 2015 public bodies are required to establish written procedures and guidelines for FOIA requests, including a separate written summary informing the public on how to submit FOIA requests, how to understand the public body's responses to FOIA requests, deposit requirements, fee calculations and avenues for challenging and appealing the public body's denial of a request. The City of Chelsea has complied with these requirements.

You are encouraged, but are not required, to use the City's FOIA request form to make your request.  If you do not use the form, your request should provide detailed information that will assist the City in locating the documents you are requesting.  The City is entitled to recover reasonable costs incurred in responding to a request.  You will be advised of that cost in writing shortly after you make your request.  Payment must be received before the document is released.
